- "Patterns" specifically refers to the knitting and crochet patterns, instructions, and schematics, whether sold individually or as part of a collection, in digital or physical format.

- "User-Generated Content" (UGC) refers to any content, including text, images, videos, reviews, comments, forum posts, and project photos, submitted, posted, or displayed by Users on the Site.

Knotivira will not be liable for any loss or damage arising from your failure to comply with this section.
We implement security measures to protect your account, but you play a crucial role in maintaining its security. Never share your password, and consider using a strong, unique password that you do not use for other online services.
3. Products and Services
Knotivira offers a range of physical and digital products, as well as community features, designed to enhance your fiber arts experience. We strive to provide accurate descriptions and high-quality items.
3.1. Product Descriptions
We attempt to be as accurate as possible in the descriptions of our Products and Digital Products. However, Knotivira does not warrant that product descriptions or other content of this Site is accurate, complete, reliable, current, or error-free. All descriptions, images, references, features, content, specifications, products, and prices of products and services described or depicted on the Site are subject to change at any time without notice.
Colors may vary slightly from what appears online due to differences in monitor calibration, lighting conditions, and the inherent nature of natural fibers and hand-dyed yarns. We recommend referring to physical samples or contacting customer service if precise color matching is critical for your project.
3.2. Pricing and Availability
All prices for Products and Digital Products are listed in the currency specified on the Site and are subject to change without notice. Prices do not include applicable taxes, duties, shipping, or handling charges, which will be added to your total at checkout. We reserve the right to correct any errors in pricing or product descriptions and to cancel or refuse any order placed based on incorrect information.
Product availability is subject to change. While we endeavor to keep our inventory updated, there may be instances where an item you ordered is out of stock. In such cases, we will notify you promptly and offer alternatives, a backorder option, or a full refund for the unavailable item.

Knotivira does not directly store your sensitive payment card information. All payment transactions are processed through secure, PCI-DSS compliant third-party payment gateways. While these processors use industry-standard security measures, Knotivira cannot be held responsible for any security breaches or unauthorized access to your payment information that occurs at the third-party payment processor's end.

You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
5. Shipping and Delivery

This means that once the package leaves our facility and is in the hands of the shipping carrier, you are responsible for any loss or damage to the items. We recommend purchasing shipping insurance if you are concerned about potential loss or damage during transit.
5.7. Incorrect Shipping Information
It is your responsibility to provide accurate and complete shipping information at the time of purchase. Knotivira is not responsible for delays, non-delivery, or additional shipping charges incurred due to incorrect or incomplete address details provided by the user. If a package is returned to us due to an incorrect address, you may be responsible for re-shipping fees.
6. Returns, Refunds, and Exchanges
Knotivira is committed to your satisfaction. This section outlines our policy for returns, refunds, and exchanges for physical products.
6.1. Return Eligibility

6.2. Return Process

6.3. Refunds

6.4. Exchanges
If you wish to exchange an item, please follow the return process for the original item and place a new order for the desired item. This ensures that the new item is in stock and can be shipped promptly. If the exchange is due to our error, we will cover the shipping costs for both the return and the new shipment.

7. Digital Products and Patterns
This section outlines specific terms related to the purchase and use of Digital Products, primarily knitting and crochet patterns, from Knotivira.
7.1. Nature of Digital Products
Digital Products, such as patterns, e-books, and digital workshop access, are intangible goods delivered electronically. Once a Digital Product has been downloaded or accessed, it cannot be returned or exchanged. Therefore, all sales of Digital Products are final and non-refundable, except where required by law or in cases of demonstrable technical error preventing access to the product.
7.2. Licensing and Permitted Use of Patterns
When you purchase or download a Pattern from Knotivira, you are granted a limited, non-exclusive, non-transferable, revocable license to use the Pattern for your personal, non-commercial use only. This means:
- You may download and print a copy of the Pattern for your personal use.
- You may create physical items (e.g., knitted or crocheted garments, accessories, home decor) from the Pattern for your personal use or as gifts.
- You may sell a limited number of finished items made from Knotivira Patterns on a small-scale, handmade basis, provided that you clearly credit "Knotivira" as the pattern designer in your product description. This "small-scale, handmade basis" typically refers to individual crafters selling items directly to consumers, not mass production or factory manufacturing.
You are expressly prohibited from:
- Sharing, distributing, selling, reselling, reproducing, publishing, or otherwise making the Pattern available to others, whether in digital or physical form, without explicit written permission from Knotivira.
- Modifying, adapting, translating, reverse engineering, decompiling, or disassembling any part of the Pattern, except as necessary for your personal use in creating the physical item.
- Using the Pattern for large-scale commercial production or manufacturing without a separate commercial licensing agreement with Knotivira.
- Claiming the Pattern as your own design or removing any copyright notices or branding from the Pattern.
- Using the Pattern to create derivative digital products (e.g., translating the pattern into another language and selling it, or creating a new digital pattern based heavily on ours).
Violation of these licensing terms constitutes a breach of these Terms and may result in the termination of your Account and legal action for copyright infringement.
7.3. Access to Digital Products
Upon successful purchase, Digital Products will typically be available for immediate download via a link provided on the order confirmation page and/or sent to your registered email address. You may also be able to access your purchased Digital Products through your Knotivira Account dashboard. It is your responsibility to download and save your Digital Products promptly after purchase. Knotivira is not responsible for lost files once they have been successfully delivered and downloaded.
8. User-Generated Content (UGC)
Knotivira encourages community engagement through features like the Creator Collective, product reviews, and comments. This section outlines the terms governing User-Generated Content.
8.1. Responsibility for UGC
You are solely responsible for any UGC that you submit, post, or display on the Site. By submitting UGC, you represent and warrant that:
- You are the sole author and owner of the intellectual property rights in the UGC, or you have all necessary licenses, rights, consents, and permissions to publish the UGC and to grant Knotivira the rights described herein.
- Your UGC does not infringe upon, misappropriate, or violate the intellectual property rights, privacy rights, publicity rights, or any other rights of any third party.
- Your UGC does not contain any material that is unlawful, harmful, defamatory, obscene, harassing, threatening, abusive, hateful, or otherwise objectionable.
- Your UGC does not contain any computer viruses, worms, or other potentially damaging computer programs or files.
- Your UGC complies with all applicable laws and regulations.
8.2. License Grant to Knotivira
By submitting UGC to the Site, you grant Knotivira a worldwide, non-exclusive, royalty-free, fully paid, transferable, and sublicensable license to use, reproduce, distribute, prepare derivative works of, display, and perform the UGC in connection with the Service and Knotivira's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels. This license includes, but is not limited to, the right to use your UGC in our marketing materials, social media posts, newsletters, and on other pages of our Site.
You also grant each User of the Service a non-exclusive license to access your UGC through the Service, and to use, reproduce, distribute, display, and perform such UGC as permitted through the functionality of the Service and under these Terms.
This license continues even if you stop using the Service, unless you specifically request deletion of your UGC where such deletion is feasible and not subject to legal retention requirements.
8.3. Content Standards
All UGC must comply with the following content standards:
- It must be accurate (where it states facts) and genuinely held (where it states opinions).
- It must not contain any material which is defamatory of any person, obscene, offensive, hateful or inflammatory.
- It must not promote sexually explicit material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
- It must not infringe any copyright, database right, or trademark of any other person.
- It must not be likely to deceive any person.
- It must not be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
- It must not promote any illegal activity.
- It must not be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience, or needless anxiety.
- It must not be likely to harass, upset, embarrass, alarm, or annoy any other person.
- It must not be used to impersonate any person, or to misrepresent your identity or affiliation with any person.
- It must not give the impression that it emanates from Knotivira, if this is not the case.
- It must not advocate, promote, or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.
8.4. Monitoring and Removal of UGC
Knotivira reserves the right, but is not obligated, to monitor, edit, or remove any UGC at its sole discretion, without notice, for any reason, including if we believe that the UGC violates these Terms or is otherwise objectionable. We are not responsible for any failure or delay in removing such content. We may also take any action with respect to any UGC that we deem necessary or appropriate in our sole discretion, including referring to law enforcement authorities.
9. Intellectual Property Rights
All content on the Knotivira Site, including text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, as well as the compilation of all content on this Site, is the exclusive property of Knotivira or its content suppliers and protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
9.1. Knotivira Content
The Knotivira name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Knotivira or its affiliates or licensors. You must not use such marks without the prior written permission of Knotivira.
All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners. Nothing in these Terms grants you a right to use any trademark, service mark, logo, or trade name of Knotivira or any third party.
9.2. Digital Products (Patterns)
As detailed in Section 7.2, Patterns and other Digital Products remain the intellectual property of Knotivira or its designers. Your purchase grants you a limited license, not ownership. Any unauthorized reproduction, distribution, or commercial use of Patterns is strictly prohibited and will be subject to legal action.
9.3. Reporting Infringement
If you believe that any content on the Site infringes your copyright or other intellectual property rights, please contact us immediately at [copyright infringement email] with the following information:
- A description of the copyrighted work or intellectual property that you claim has been infringed.
- A description of where the material that you claim is infringing is located on the Site.
- Your address, telephone number, and email address.
- A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

- To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
- To impersonate or attempt to impersonate Knotivira, a Knotivira employee, another user, or any other person or entity (including, without limitation, by using email addresses or screen names associated with any of the foregoing).
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which, as determined by us, may harm Knotivira or users of the Site or expose them to liability.
Additionally, you agree not to:
- Use the Site in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the Site, including their ability to engage in real-time activities through the Site.
- Use any robot, spider, or other automatic device, process, or means to access the Site for any purpose, including monitoring or copying any of the material on the Site.
- Use any manual process to monitor or copy any of the material on the Site or for any other unauthorized purpose without our prior written consent.
- Use any device, software, or routine that interferes with the proper working of the Site.
- Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
- Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site.
- Attack the Site via a denial-of-service attack or a distributed denial-of-service attack.
- Otherwise attempt to interfere with the proper working of the Site.
11. Disclaimer of Warranties
Your use of the Site, its content, and any services or items obtained through the Site is at your own risk. The Site, its content, and any services or items obtained through the Site are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied.
Knotivira hereby disclaims all warranties of any kind, whether express or implied, statutory, or otherwise, including but not limited to any warranties of merchantability, non-infringement, and fitness for particular purpose.
Neither Knotivira nor any person associated with Knotivira makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the Site. Without limiting the foregoing, neither Knotivira nor anyone associated with Knotivira represents or warrants that the Site, its content, or any services or items obtained through the Site will be accurate, reliable, error-free, or uninterrupted, that defects will be corrected, that our Site or the server that makes it available are free of viruses or other harmful components, or that the Site or any services or items obtained through the Site will otherwise meet your needs or expectations.
The foregoing does not affect any warranties which cannot be excluded or limited under applicable law.
12. Limitation of Liability
To the fullest extent permitted by law, in no event will Knotivira, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Site, any websites linked to it, any content on the Site or such other websites, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.
The foregoing does not affect any liability which cannot be excluded or limited under applicable law. In no event shall Knotivira's total liability to you for all damages, losses, and causes of action whether in contract, tort (including, but not limited to, negligence), or otherwise, exceed the amount paid by you, if any, for accessing or using the Site or purchasing products or services through the Site during the twelve (12) months immediately preceding the date of the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless Knotivira, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, your User-Generated Content, any use of the Site's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Site.
14. Governing Law and Jurisdiction
All matters relating to the Site and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of India without giving effect to any choice or conflict of law provision or rule. Specifically, the laws of Delhi, India, shall apply.
Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the courts of Delhi, India, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
15. Dispute Resolution
In the event of any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Site, the parties agree to first attempt to resolve the dispute informally and in good faith. This informal resolution process may include direct communication between the parties to discuss and negotiate a settlement.
If the parties are unable to resolve the dispute informally within a reasonable period (e.g., 30 days), either party may elect to pursue binding arbitration as the sole and exclusive means of resolving disputes, subject to the provisions below. The arbitration shall be conducted in accordance with the provisions of the Arbitration and Conciliation Act, 1996 (as amended) of India.
15.1. Binding Arbitration
All claims and disputes arising under or relating to these Terms are to be settled by binding arbitration in Delhi, India, or another location mutually agreed upon by the parties. The arbitration shall be administered by a single arbitrator appointed in accordance with the rules of a recognized arbitration institution in India (e.g., the Delhi International Arbitration Centre or Indian Council of Arbitration). The decision of the arbitrator shall be final and binding on both parties.
The arbitration shall be conducted in English. The costs of the arbitration, including the arbitrator's fees and administrative expenses, shall be shared equally by both parties, unless the arbitrator determines otherwise. Each party shall bear its own legal fees and expenses incurred in connection with the arbitration.
15.2. Exceptions to Arbitration

Furthermore, nothing in this section shall be construed to prevent Knotivira from seeking relief in any court of competent jurisdiction for claims related to the collection of payment for products or services, or for claims related to your breach of the "Prohibited Uses" section of these Terms.
15.3. Class Action Waiver
YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST KNOTIVIRA ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
